Terms of Service

These Terms of Service govern your access to and use of ExamForge. By creating an account, starting a subscription, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1) Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you represent that you have permission from a parent or legal guardian.

2) Accounts & Security

You are responsible for your account activity and for keeping your login credentials secure. You agree to provide accurate information and keep it up to date.

3) The Service

ExamForge provides subscription-based access to digital educational tools and content (for example: exams, question banks, explanations, flashcards, imports, AI-assisted generation, and progress tracking). Features, subscription perks, and services may be added, removed, or modified at any time without advance notice.

4) User Content, Uploads & Permissions

Certain features allow you to upload, import, store, generate, or share prompts, notes, PDFs, images, question banks, flashcards, explanations, and other materials ("User Content"). You retain any rights you own in User Content, but you grant us a non-exclusive, worldwide license to host, copy, format, store, transmit, display, and otherwise process that User Content as necessary to operate, secure, and provide the Service and the features you request.

You represent and warrant that you own or control the necessary rights and permissions for any User Content you submit and that your use of the Service does not violate any law, contract, confidentiality duty, exam rule, or third-party right.

5) Copyright Complaints & Infringing Material

You may not upload, import, submit, generate for redistribution, or share copied, pirated, leaked, scraped, memorized, or plagiarized material that you do not have the right to use. This includes commercial question banks, prep books, answer keys, PDFs, images, explanations, and other copyrighted study content.

We may reject imports, remove or disable content, suspend or terminate accounts, and cooperate with rights holders or authorities where we reasonably believe content violates these Terms or applicable law. If you believe material on the Service infringes your rights, contact [email protected] with enough detail for us to identify the work and the allegedly infringing material.

6) AI Features & Generated Content

Some features use AI or other automated systems to generate questions, flashcards, explanations, summaries, recommendations, or related study materials. By using those features, you authorize us and our service providers to process the prompts, uploads, and outputs needed to provide them.

AI-generated output may be inaccurate, incomplete, outdated, biased, offensive, unavailable, similar to third-party content, or unsuitable for your use case. We do not guarantee that AI-generated output will be factually correct, educationally sufficient, original, or non-infringing. You are solely responsible for reviewing and validating any output before relying on it, importing it, sharing it, publishing it, or using it in academic, professional, or clinical contexts.

7) Payments & Taxes

Subscriptions are paid and billed through PayPal. PayPal handles payment processing, invoicing/receipts, fraud checks, chargebacks, and collection of applicable taxes where required. We do not store full payment card details.

8) Subscription Renewal, Billing, and Cancellation

• Auto-renewal: Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date.
• Billing timing: You are charged at the start of each billing period.
• How to cancel: Cancel future renewals through account/billing settings (if available) or by emailing [email protected].
• After cancellation: Cancellation stops future charges. You typically keep access until the end of the current paid billing period.

9) Refunds

Refunds for subscriptions are governed by the Refund Policy at /refund-policy. You may request a full refund within 14 days of your initial subscription purchase or renewal payment. After this window, payments are final except where required by law.

10) AI Budget

AI budget is an internal usage balance used for AI-powered features such as question generation. By purchasing AI budget, you agree to the following terms:

• Non-refundable: All AI budget purchases are final and non-refundable. AI budget cannot be exchanged for cash or transferred to another account.
• Expiration: Purchased AI budget expires 90 days from the date of purchase. Unused AI budget will be forfeited after this period.
• Bonus budget: Any historical bonus or promotional budget is subject to the same expiration policy and is non-refundable. New trial and referral bonus budget grants are retired.
• Monthly subscriber AI budget: Subscribers receive monthly AI budget that expires at the end of each calendar month and does not roll over.
• No guarantees: AI budget is consumed based on AI processing costs. We do not guarantee specific outcomes from AI budget usage.

11) Acceptable Use

• Do not share, resell, sublicense, or redistribute your subscription access.
• Do not copy, scrape, systematically extract, or reverse engineer the Service or content (except where permitted by law).
• Do not upload, import, generate for redistribution, or distribute content that infringes, misappropriates, or plagiarizes third-party rights, including commercial study materials.
• Do not attempt unauthorized access, interfere with security features, or disrupt the Service.
• Do not use the Service to violate laws or infringe rights.

12) Intellectual Property

Except for User Content you submit, all content and materials on the Service (including questions, explanations, databases, graphics, branding, and software) are owned by us or licensed to us and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use while subscribed and in good standing.

13) Beta Service

The Service is provided as a "beta" version and is still undergoing testing and development. You acknowledge and agree that the Service may contain bugs, errors, and other problems. We make no representations or warranties about the completeness, accuracy, or reliability of the Service.

14) Educational Disclaimer (No Medical or Professional Advice)

The Service, including AI-generated materials, is for educational and informational purposes only and does not constitute medical advice, diagnosis, treatment, legal advice, or any other professional advice. It is not a substitute for clinical judgment, professional supervision, or accredited training, and must never be used to make decisions about actual patient care.

AI-generated questions, explanations, and study materials may resemble real exam items or third-party preparation content. You are responsible for ensuring you do not reproduce, distribute, or use such material in violation of exam rules, confidentiality obligations, or third-party rights, including in any live examination setting.

Always verify clinically important information against current primary literature and accredited clinical guidelines before relying on it. The Service is a study aid only and is not a clinical decision-support tool.

15) Availability & Changes

The Service is provided "as available." We do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time without notice or liability.

16) Suspension & Termination

We may suspend or terminate access if you violate these Terms, if required by law, or to protect the Service or others. You may stop using the Service at any time.

17) Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT USER-SUBMITTED OR AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, ORIGINAL, ERROR-FREE, AVAILABLE, OR NON-INFRINGING.

18) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID IN THE LAST 3 MONTHS (OR €50, WHICHEVER IS GREATER), UNLESS APPLICABLE LAW REQUIRES OTHERWISE.

19) Governing Law

These Terms are governed by the laws of the United Arab Emirates, except where mandatory consumer protection laws in your country of residence apply.
